Article 15 Actions For CY 2013 Published Nov. 21, 2013 By 386th AEW Legal Office 386th Air Expeditionary Wing SOUTHWEST ASIA -- So far this year, 17 Airmen here were punished under Article 15 of the Uniform Code of Military Justice for committing criminal acts as listed below. An E3 received reduction to the grade of E2, forfeitures of $275.00 pay per month for two months, and a reprimand for violating a general regulation by using an aerosol can as a stimulant. Abuse of intoxicating substances also calls for mandatory discharge unless seven retention criteria are met. 2. An E3 received reduction to the grade of E2, 30 days restriction to base, and a reprimand for sleeping while posted as a sentinel. 3. An E3 received a suspended reduction to the grade of E2, forfeitures of $275.00 pay per month for two months, and a reprimand for sleeping while posted as a sentinel. 4. An E3 received reduction to the grade of E2, a suspended reduction to E1, and a reprimand for negligently discharging a firearm. 5. An E3 received a suspended reduction to the grade of E2, forfeiture of $849.00 pay per month for one month, and a reprimand for larceny of non-military property of a value less than $500.00. 6. An E4 received reduction to the grade of E3, seven days extra duty, and a reprimand for two specifications of provoking speeches and gestures and three specifications of simple assault. 7. An E4 received a suspended reduction to the grade of E3, forfeitures of $949.00 pay per month for two months, and a reprimand for violating General Order 1-B. 8. An E4 received a suspended reduction to the grade of E3, 45 days extra duty, and a reprimand for violating General Order 1-B. 9. An E4 received reduction to the grade of E3 and a reprimand for sleeping while posted as a sentinel. 10. An E4 received a suspended reduction to the grade of E3 and a reprimand for service discrediting disorderly conduct and two specifications of provoking speeches or gestures. 11. An E4 received forfeitures of $750.00 pay per month for two months (one month suspended) and a reprimand for negligent dereliction of duty by failing to safely operate a motor vehicle causing damage to military property. 12. An E4 received a suspended reduction to the grade of E3, suspended forfeitures of $1007.00 pay per month for two months, and a reprimand for larceny of military property of a value less than $500.00. 13. An E5 received reduction to the grade of E4 and a reprimand for sleeping while posted as a sentinel. 14. An E5 received a suspended reduction to the grade of E4, forfeitures of $500.00 pay per month for two months, 10 days extra duty and a reprimand for negligent dereliction of duty when he left a weapon unsecured at the DFAC. 15. An E6 received a suspended reduction to the grade of E5, forfeitures of $1532.00 pay per month for two months, 45 days extra duty, and a reprimand for five specifications of cruelty and maltreatment. 16. An E6 received a reduction to the grade of E5, forfeitures of $925.00 pay per month for two months and a reprimand for committing cruelty and maltreatment, provoking speeches or gestures and assault consummated by a battery. 17. An O2 received forfeitures of $2000.00 pay per month for one month and a reprimand for theft of government property of a value more than $500.00. (Note: officers cannot be reduced in rank except by SECAF at the time of retirement through an Officer Grade Determination.) Along with nonjudicial punishment under Article 15 of the Uniform Code of Military Justice, members who commit misconduct are subject to other adverse actions. This includes Administrative Discharge Actions and Administrative Demotions. Additional misconduct may be met with more severe adverse actions, such as trial by court-martial.
