Article 32 investigation ends

The Article 32 investigation into alleged detainee mistreatment ended yesterday at Forward Operating Base Salerno.

Capt. Roger T. Hill and 1st Sgt. Tommy L. Scott, both of 1st Battalion, 506th Infantry Regiment, gave unsworn statements prior to closing remarks by the government and their legal counsel.

The investigating officer will now present a recommendation to the brigade commander on whether to drop charges, impose non-judicial punishment, or to proceed with a court martial.

The service members have been formally charged with detainee mistreatment and dereliction of duty to report detainee mistreatment.

The charges were filed as a result of an incident that occurred in eastern Afghanistan in August.

Similar to the civilian criminal process, the service members are presumed innocent of all charges unless proven otherwise.
